Just curious I know if a Felon is in possesion of a firearm they are charged with been a Felon in possession of a firearm a Federal charge however what is the charge if someone convicted of a Domestic Violence Misdemeanor is in possesion of a firearm in my small county I can recall nobody been charged having been convicted of Domestic Violence and been in possesion of a firearm Is this also a Federal charge or is it left up to the individual States to determine? thanks, Bear101

In my experience as a local cop the feds don't get involved with just one case of a felon in possession of a firearm; unless the possession is committed in the venue of a federal jurisdiction, or in concert with other federal crimes in which the U.S district court would already be involved. Regarding the domestic violence convict in possession of a firearm, all states have adopted the "Lautenburg Ammendment" which gives each state the ability to bring its own charge. Hope this helps...

In Virginia they do they have a program called Project Exile which takes these cases out of state court and puts them in federal court because the penalties are normally harsher. Also recently I was involved with a case the BATF is supposed to adopt. If it happens I will let you know.
