View Full Version : Anyway around this??
I just picked up a NJ Firearms card application along with Application to purchase a handgun. It states MUST be 21 to purchase a handgun in the state of new jersey. Im 19. Is there anyway around this?? Could i apply for a permit in another state and transfer it to New jersey? or do i still have to turn 21 regardless of other permits in order to purchase a handgun in Nj?
And if i could transfer it, my question is can i get it in the first place from say Penn. or Ny seeing as im not a resident of that state.
Sorry Bub, your not going to get by this legally. I may be wrong, but I believe that federal law requires you be 21 to purchase a handgun or handgun ammunition. At least that was how it was when I last held an FFL. On the permit side, VERY< VERY few states recognize a permit to carry or a puchase permit from another state. This again brings up the problem; their not going to issue a permit to anyone that can't legally buy a handgun.
Sorry....
Thank you Jsavage i appreciate the response.
I just thought it was still 18 to purchase, like my hunting instructor told me about over a decade ago. I guess i should study up on gun laws a little more.
There are limited situations where a person under 21 can own a handgun but this is mostly restricted to Police Officers, Corrections and Military.
I knew a 20 year old Deputy working in a Jail who had to get a letter from the Dept. to buy his pistol, not a big deal as it was for official use.
As for permits from other states, you could use another states permit under restricted situations but not likely to work if you live in one state and have a permit from another.
(Residence of 6 Months to a year is often required to get a permit)

I just wanted to add that I've heard alot of discrepancies involving www.packing.org I wouldn't take their word as gold.
Just my .02 :)

In FL you can own a gun at 18 but can only buy one at 21. The way around this is to have your parents buy the gun for you then transfer it to you. You can't get a carry permit until 21, but FL does not require any permit to own. I knew a guy I worked with who had to do this cuz he wasn't 21. Dept letter will not help, only to get high cap mags, and you still have to wait.
As for NJ you can't get around it. Unless you are able to get the gun in another state, but you can't take the gun out of your home. You don't need a permit to have a gun in your home but if you ever want to shoot it, legally, at the range you need a permit.
If this is for good purpose and the security company i work for backs me up...then would that somehow give me a way around??
Like a previous poster stated.

Would Security (wannabe lol) be an "official" use?
And once again thank you for all responses.
If I was you I would look a little deeper into the law in NJ. I know when I first got my permits I was 18. I could own hand guns and carry. I could also buy a handgun from a private sale, but could not buy one from a dealer until I was 21. If all else fails have a relative buy it and you use it. If you have the permit then its legal for you to use it.
Well not only do u have to be 21 to purchase a handgun, but also 21 to APPLY for a permit to purchase. thats the problem.
Pennsylvania is much the same as Florida. One can own a firearm at 18, but cannot purchase or apply for a concealed carry permit until 21. Pennsylvania does have an "open carry law" in that one does not need to possess a permit in order to carry a firearm in plain sight.
P.S. In a vehicle is considered concealed regardless of where the firearm is located.
ACLP82,
Below is the Fed Law on purchasing a handgun. Fed law doesn't say anything about people between the ages of 18-21 owning or possessing a handgun or purchase from a private person from within your state of residence, if you are not a felon. However, your state law probably does and it may also make an exception for employment, target practice, etc. You need to check with a lawyer, a prosecuting attorney, or someone that knows your state law. If your State Patrol has a web site it may list the state statue and you could look it up there. Fed Law does prevent you from purchasing in a state you don’t live in, unless you process it through a dealer in the state where you live, even if purchased from a private person. Hope this helps.
U.S. Code Title 18, CHAPTER 44 - FIREARMS, Sec. 922. Unlawful acts
· (a) It shall be unlawful -
o (3) for any person, other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to transport into or receive in the State where he resides (or if the person is a corporation or other business entity, the State where it maintains a place of business) any fire arm purchased or otherwise obtained by such person outside that State, except that this paragraph (A) shall not preclude any person who lawfully acquires a firearm by bequest or intestate succession in a State other than his State of residence from transporting the firearm into or receiving it in that State, if it is lawful for such person to purchase or possess such firearm in that State,
· (b) It shall be unlawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver -
o (1) any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe is less than eighteen years of age, and, if the firearm, or ammunition is other than a shotgun or rifle, or ammunition for a shotgun or rifle, to any individual who the licensee knows or has reasonable cause to believe is less than twenty-one years of age;
So our best advise is - be patient.
Less than 2 years to go !!!
Keep safe everybody.
